First up is the High Court's decision to side with states in the South Dakota vs. Wayfair case — giving states the power to collect sales taxes from online retailers selling to customers in their state even if they don't have a physical presence in the state — and the mixed reaction from the retail community. Next the pair analyze the Supreme Court's decision to vote in favor of American Express — and essentially against retailers — in a lawsuit over rules the company imposes on merchants that accept its credit cards. The Supreme Court sided with American Express, ruling that merchants which accept American Express generally can’t encourage customers to use other credit cards, even though they charge merchants lower fees.
