Macyโ€™s Trial Over Martha Stewart Rights Set for February

Macy's bid to prevent Martha Stewart Living Omnimedia Inc. from executing a sales agreement with J.C. Penney is set to go to trial Feb. 19. The case won't be tried before a jury and there will be no need to decide damages, Judge Jeffrey K. Oing said yesterday in New York state court in Manhattan. Any potential damages in the dispute "are going to pale in comparison to the injunction," Oing said during a hearing. "That's the real big bucks there โ€” if I stop this deal." Macy's, the second-biggest U.S. department-store chain, claims it has an exclusive right to sell Martha Stewart Living products in certain categories.

WWD reports that the deal, which fueled some rumors and speculation last month, closed on Dec. 31 to the tune of $130 million. The partnership should aid both brands: Intermix can use Gap's massive reach to grow its own retail and e-tail presence, while Gap can benefit from Intermix's expertise in the contemporary luxury market. But most exciting: Gap also intends to beef up Intermix's website with some innovative-sounding improvements.

Online Holiday Spending Grows 14%

comScore, a leader in measuring the digital world, today reported the final 2012 holiday season retail e-commerce spending totals. $42.3 billion was spent online during the November-December holiday shopping season, marking a 14 percent increase from 2011. The latter portion of the season saw several days with particularly strong growth, including Free Shipping Day on Monday, Dec. 17 (up 76 percent to $1.013 billion) and Christmas Day (up 36 percent to $288 million), but they couldn't make up for the spending growth shortfall earlier in the month. 

Cuddledown Acquired by Potpourri Group

Luxury bedding company Cuddledown Inc. has been acquired by American Capital Ltd.'s Potpourri Group Inc., a specialty catalog company. Bobby Hipsher fills a comforter with down in 2011 at the Cuddledown Inc. factory on Canco Road in Portland. Terms of the deal were not disclosed. American Capital, a publicly traded private equity firm, said the transaction was completed in December. Officials at Cuddledown, which got its start in Yarmouth, did not immediately return calls seeking comment.

Cuddledown Acquired by Potpourri Group

Luxury bedding company Cuddledown Inc. has been acquired by American Capital Ltd.'s Potpourri Group, a specialty catalog company. Terms of the deal weren't disclosed. American Capital, a publicly traded private equity firm, said the transaction was completed in December. The deal marks the second acquisition of a Maine-based company by the Potpourri Group in recent months. In June, it acquired FetchDog, a dog accessories catalog and internet site co-founded by actress Glenn Close and her husband, David Shaw.
